Terms of Service

1. Agreement to these Terms

These Terms of Service (the “Terms”) are a legal agreement between you and HYUPERON, LLC, a company registered in the Republic of Armenia with its address at 19A Koryun St., floor 8, room 3, Yerevan 0009, Armenia (“we”, “us” or “our”). They govern your use of the Camera Guru mobile application (the “App”) and the website camguru.app (together, the “Service”).

By downloading, installing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Camera Guru helps you discover, connect to and view compatible IP and network cameras on your local network, and, where available, view them remotely over the internet. Features may differ by platform, device, camera model and network setup, and some features may be offered only as part of a paid subscription.

Camera Guru is an independent product. It is not affiliated with, endorsed by or sponsored by any camera, router or device manufacturer. We do not guarantee that any particular camera or router will be compatible with the Service.

3. Eligibility

You must be at least 13 years old, or 16 in the EEA and UK, to use the Service. If you are under the age of legal majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

4. Your account

The App may create an anonymous account automatically, and you may choose to register with an email address and password. You are responsible for keeping your login details confidential, for all activity under your account, and for giving us accurate information. Please tell us immediately at support@camguru.app if you suspect unauthorized use of your account.

5. Your cameras and lawful use

You may use the Service only with cameras and devices that you own or are legally authorized to access. You are solely responsible for how you install and use your cameras and the Service, including compliance with all applicable laws on video surveillance, audio recording, privacy, data protection and the rights of others. Among other things, you agree that you will not:

• access, or try to access, any camera, network or device without authorization;
• use the Service to watch or record people where they have a reasonable expectation of privacy, or otherwise in breach of their rights, including without any notice or consent the law requires;
• use the Service to stalk, harass, threaten or harm anyone;
• use the Service for any unlawful, fraudulent or harmful purpose; or
• interfere with, disrupt, overload or attempt to gain unauthorized access to the Service, our servers or other users’ data.

We may suspend or terminate access for any use that we reasonably believe violates this section.

6. Remote access

Where available, remote access lets you view your cameras when you are away from home. To provide it, the App may ask your router (using UPnP) to forward a network port to your camera, and our relay servers connect to the camera to deliver live video to you. By turning on remote access, you understand and agree that:

• forwarding a port makes your camera reachable from the internet, which can expose it to unauthorized connection attempts;
• you are responsible for using a strong, unique camera password, keeping your camera and router firmware up to date, and deciding whether remote access is appropriate for you;
• we are not responsible for security vulnerabilities in your camera, router or other third-party equipment, or for settings changed on them; and
• remote access depends on your internet provider, router and camera, and may not work in every setup (for example behind carrier-grade NAT, or when your router or camera changes its address).

You can turn off remote access by deleting the camera in the App or deleting your account. You can also remove any port-forwarding rule in your router’s settings.

7. Not a security or emergency service

The Service is a convenience tool for viewing your own cameras. It is not a professional security, alarm or monitoring service and is not a substitute for one. We do not monitor your cameras, and we do not guarantee that video, connections or notifications will be available, timely, complete or accurate. Do not rely on the Service to protect life, health or property. In an emergency, contact your local emergency services.

8. Subscriptions and payments

Some features may require a paid subscription or one-time purchase, bought through the Apple App Store or Google Play (each an “App Store”). Prices, features and billing periods are shown in the App before you buy.

• Billing: payment is charged to your App Store account when you confirm the purchase.
• Automatic renewal: subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Free trials: if a free trial is offered, it converts to a paid subscription when it ends unless you cancel at least 24 hours before it ends. Any unused part of a trial is forfeited when you buy a subscription, where applicable.
• Cancellation: you can manage or cancel your subscription in your App Store account settings. Deleting the App or your account does not cancel a subscription.
• Refunds: refunds are handled by the relevant App Store under its policies. Except where required by law, we do not provide refunds or credits for partial periods.
• Price changes: we may change subscription prices. You will be notified in advance as required by the App Store and applicable law.

9. License and restrictions

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the App on devices you own or control, for your personal, non-commercial use. You agree not to:

• copy, modify, distribute, sell, rent or sublicense the App or any part of the Service;
• reverse engineer, decompile or disassemble the App, except to the extent applicable law expressly permits it;
• remove, alter or obscure any proprietary notices;
• bypass or interfere with any security, licensing or usage-limiting features; or
• use automated means to access the Service, or use it to build a competing product.

10. Intellectual property

The Service, including its software, design, text, graphics, logos and the Camera Guru name, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license above, these Terms grant you no rights in it. Camera, router and other product names and logos shown in the App are trademarks of their respective owners and are used only to identify compatible devices.

You keep all rights to your content, including your camera video. We do not claim ownership of it. If you send us feedback or suggestions, you allow us to use them without restriction or compensation to you.

11. Third-party devices and services

The Service works with third-party hardware, software and services, such as cameras, routers, app stores and cloud providers, that we do not control. Their use is subject to their own terms and policies, and we are not responsible for their availability, security, functionality or content.

12. Privacy

Our Privacy Policy explains how we collect and use information when you use the Service, and is part of these Terms.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted or error-free operation. We do not warrant that the Service will be compatible with your devices, that it will be secure, or that video or connections will always be available.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, HYUPERON, LLC and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or property, including any loss arising from theft, intrusion, damage or failure to detect an event, arising out of or related to your use of, or inability to use, the Service. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) USD 50.

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud, gross negligence or willful misconduct, or your statutory rights as a consumer.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless HYUPERON, LLC and its affiliates, officers, employees and agents from any claims, damages, losses and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party, including through the use of your cameras.

16. Termination

You may stop using the Service at any time and delete your account in the App under Settings → Delete Account & Data. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service, giving reasonable notice where practical. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, will survive.

17. Changes

We may modify or discontinue any part of the Service at any time. We may also update these Terms. If we do, we will post the new version on this page and update the “Last updated” date. If a change is material, we will give you notice in the App or by other appropriate means before it takes effect. By continuing to use the Service after the changes take effect, you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-law rules. Before filing a claim, please contact us at support@camguru.app so we can try to resolve the dispute informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of Yerevan, Armenia. If you are a consumer, you also keep any mandatory protections and rights to bring a claim in the courts of your country of residence that apply to you under local law.

19. App store terms

If you download the App from an App Store, you also agree to that store’s terms. If you downloaded the App from the Apple App Store, the following also applies:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App does not conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection claims.
• We, not Apple, are responsible for the investigation, defense, settlement and discharge of any claim that the App infringes a third party’s intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets. If these Terms are translated, the English version prevails.
